Terms & Conditions of Hire

These Terms & Conditions apply to all bookings, hires and services provided by Kyneton Hire (“we”, “us”, “our”). By placing a booking or using our services, you (“the Hirer”) agree to these terms.
Terms of Hire
All hire payable in advance.
Deposit is refunded when all equipment is returned less charges together with security deposit for extra hire, cleaning etc.
Return of Hire Equipment
All items must be returned clean or a cleaning fee will be charged. Negligent damages and shortages will be charged for.
Daily Rates
All prices quoted are for daily hire only except where otherwise stated.
Rates shown are based on an 8 hour day / 5 day week.
Discount quotations for long term rental is available on request.
Charges are for time out, not time used.
Delivery and collection are not included in these prices.
Responsibility
It is the responsibility of the hirer to guard equipment against theft, damage or negligence until it has been returned to Kyneton Hire premises. Equipment damaged, stolen or lost will be charged to the hirer’s account.
Operating Instructions (given by our drivers or mechanics)
The customer is responsible for daily checks of oil, water, batteries and fuel.
Consumables
Consumables are charged extra.
Price Change
We reserve the right to change rates at any time without notice.
Stamp duty is payable on all hire transactions.
Interstate Use
No interstate use unless prior arrangements/notification has been made.
Trailers
Trailers are available at a reduced rate for collecting and returning Party Hire items.
1. Bookings & Payment
All hire is payable in advance unless otherwise agreed in writing.
A deposit may be required to confirm bookings over $200.
Full payment must be received prior to delivery or collection.
Prices include GST unless stated otherwise.
We reserve the right to change rates at any time without notice.
2. Hire Period
Minimum hire period is one (1) day unless otherwise stated.
Hire periods commence from delivery or collection and end upon return or pickup.
Late returns may incur additional hire charges.
3. Deposits & Refunds
Deposits are refundable once all equipment is returned in good condition, less any charges for:
extra hire time
damage
cleaning
loss
Cancellation fees may apply depending on notice period and booking size.
4. Use of Equipment
The Hirer agrees:
To use equipment only for its intended purpose.
Not to modify or repair any hired items.
To ensure equipment is kept secure and protected from theft, weather and misuse.
To follow all operating instructions provided.
The Hirer is responsible for daily checks of fuel, oil, water and batteries where applicable.
5. Responsibility for Loss or Damage
Equipment damaged, stolen or lost will be charged to the Hirer’s account at replacement or repair cost.
Normal wear and tear excepted.
The Hirer accepts full responsibility for hired equipment from delivery/collection until returned.
6. Cleaning
All equipment must be returned clean unless cleaning has been included in your hire agreement. Excessive cleaning will be charged.
7. Delivery & Access
Safe and clear access must be provided for deliveries and collections.
Additional charges may apply for difficult access, stairs, long carries or waiting time.
The Hirer is responsible for any damage to property caused by placement of hired equipment.
8. Marquees & Outdoor Equipment
Site must be level, clear and suitable prior to installation.
Underground services (water, gas, power, irrigation) must be identified by the Hirer before pegging.
We accept no responsibility for damage to underground services not disclosed.
Weather conditions remain outside our control. Bookings are not refundable due to rain, wind or temperature unless otherwise agreed.
9. Cancellations
Cancellation fees may apply depending on notice given:
More than 7 days: deposit may be refunded
Less than 7 days: deposit may be forfeited
Less than 48 hours: full hire charges may apply
Large event bookings may have custom cancellation terms.
10. Liability
All hired equipment is used at the Hirer’s risk.
We accept no liability for injury, loss or damage arising from use of hired items.
The Hirer indemnifies Kyneton Hire against any claims arising from use of the equipment.
11. Force Majeure
We are not liable for failure to perform due to events beyond our control, including extreme weather, transport disruption, power failure or illness.
12. Privacy
Personal information is handled in accordance with our Privacy Policy.
13. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
